Briefing Code
Introduction
Foleys List recognises that it is of paramount importance that both the Clerks
and the members of the List have a significant responsibility toward their Instructing
Solicitors and their clients to ensure that no delay or inconvenience occurs in
the engagement of counsel.
Moreover, it is essential that the relationship between the Instructing Solicitors
and the members of the List and their Clerks is one of trust.
Foleys List is proud of its tradition of integrity in briefing and adheres
to its Equal Opportunity Policy in briefing
as in other areas.
The Code
- The Clerks will maintain an up-to-date knowledge and understanding of the work
undertaken by, and experience of, each member of Foleys List.
- The Clerks will maintain a current list of dates during which each member of
Foleys List is available to accept work.
- When a solicitor requests a list of the names of the barristers available for
a specific type of case, the Clerks will only put forward names of Barristers
who are appropriate for the brief.
- The Clerks will include women in their recommendations as far as practicable
in all areas of the law in accordance with the List Equal Opportunity Policy.
- The Clerks will respond promptly to every communication from Instructing Solicitors
and will provide accurate responses to any queries.
- Upon a Clerk accepting an engagement for a member of Foleys List, the
Clerk will communicate promptly with the barrister engaged.
- Each member of Foleys List will respond as promptly as possible to any
communications from an Instructing Solicitor.
- The Clerks, staff and members of Foleys List will continue to extend full
courtesy to every Instructing Solicitor and his or her staff.
- Upon a member of the List who is engaged to appear in a matter becoming "jammed",
such will be promptly communicated to the Instructing Solicitor and every assistance
will then provided by both the member and the Clerks to ensure that the Solicitor
and the client are not disadvantaged.
