Shivani Pillai (B.A., LL.B.) was admitted to practice in 1997 and signed the bar roll in November 2000. Shivani practices predominantly in criminal law including crimes family violence, crimes compensation, confiscation, road safety offences and occupational health and safety. She also has a keen interest in planning law. Her areas of speciality are white collar fraud and intervention orders. She has appeared in the Federal Court, Supreme Court of Appeal, Supreme Court, County Court, Magistrates' Court, Children's Court and Victorian Civil and Administrative Appeals Tribunal. In 1999, Shivani was appointed as the Associate to Justice Hampel of the Supreme Court of Victoria. As part of this role, she was the Editor of the 'Current Criminal Cases', worked with the Australian Advocacy Institute, conducted examinations de bene esse (examinations of foreign and dying witnesses), researched case law and drafted judgments. She was previously a lawyer with the Commonwealth Director of Public Prosecutions and a legal liability consultant/investigator with G. Hughes and Associates in personal injuries. Her commitment to advocacy and social justice issues began in 1991 when she was offered a position as a part-time volunteer solicitor's assistant with the Legal Aid Commission of Victoria Criminal Law Division. NOTABLE CASES: Junior Prosecuting Counsel in Supreme Court murder trial based largely on the admissibility of enhanced CD recordings and transcripts as an aide memoire (R v David Selway, January - May 2007). Junior to Christopher Maxwell Q.C. (now President of the Supreme Court of Victoria Court of Appeal) defending, pro bono, a peace activist charged with criminal damage, who was acquitted on the grounds of the absence of intent (Police v Pretam Kaur, November 2004). Successfully prosecuted a breach of s.22 of the Occupational Health & Safety Act 1985, involving the electrocution of a third year apprentice linesman employed by Vic Tech Group Training Ltd. while working for Powercor Australia Ltd (R v Powercor Australia Ltd., March - April 2004). Defended an insurance fraud and obtained a nolle prosequi in a 1.4 million dollar (Aus) property deception in the County Court of Victoria. Successfully resolved a drug trafficking matter involving telephone intercepts and covert operatives against seven accused, acting on behalf of the prosecution.
