Marcus Clarke (LL.B., B.Ec.)

Since joining the Victorian Bar (26 November, 1987), my main area of practice has been commercial litigation. I regularly give advice and conduct cases in relation to banking and finance, insolvency, corporations, insurance, trade practices, equity, property, intellectual property and professional negligence.

My predominant areas of practice are trade practices, fraud, banking, property, corporations law, insurance, professional negligence and insolvency law. I represent many leading banks and financial institutions (such as the National Bank, the A.N.Z. Bank and OCBC), insurers (the L.P.L.C., C.G.U. and Civic Mutual Plus) and government bodies (the State of Victoria, local Councils, the Official Trustee in Bankruptcy and the Registrar of Titles), and regularly appear in the Supreme Court and the Federal Court on behalf of such entities.

I have also recently been involved in a lengthy, complex commercial arbitration before Professor Uff Q.C., of the English Bar, which was concluded in February, 2007.

I have for some years been on a general retainer by the Registrar of Titles to give advice on a range of matters including claims made for indemnity under the Transfer of Land Act.

Further, I have on numerous occasions been retained to advise on corporate and personal insolvency matters and have conducted extensive public examinations.
