Carmella Ben-Simon (B.A., LL.B.) has practised law in Victoria for over 20 years.

Carmella was admitted to practice in 1988 after completing her LLB and BA at Monash University and her Articles of Clerkship. She practised as a Solicitor with Sackville Wilks & Co, a Melbourne firm, mainly working in commercial litigation. In 1989 she signed the Bar Roll of Counsel and read with Henry Jolson QC.

Carmella has gained experience in both the civil and criminal jurisdictions over her years of practice, obtaining a good rounded legal knowledge and experience in conducting complex legal litigation in a variety of Courts and Tribunals. Consolidating Carmella's experience in commercial litigation and trial work, Carmella developed a practice in Family Law whilst at the same time appearing in other civil and criminal matters. Carmella's practice in Family Law has involved her in many complex trials, including:

  • Property settlements
  • Living and contact arrangements
  • Relocation and abduction of children
  • De facto relationships
  • Domestic violence
  • Guardianship
  • Superannuation
  • Child support and spousal maintenance

Carmella is a Certified Mediator and appears in Mediations and Arbitrations in both Commercial and Family Law matters. Carmella is briefed to appear on behalf of individuals, Government departments, national and international residents and corporations, at first instance and on Appeal.

Carmella speaks at seminars for professional eduction of legal practitioners, Government department professionals, medical practitioners and psychologists and serves on the Committee for the Foley's List of Barristers. Carmella is a Member of various legal associations and has worked previously as a Law Lecturer and journalist/editor.

When not working, Carmella enjoys spending time with her family, jogging and cycling, entertaining friends and family, travelling and reading.
