The Victorian Court of Appeal’s decision in Riley v The Queen concerned a procedural anomaly arising from the Criminal Procedure Act 2009(Vic)(‘CPA’). In particular, this appeal queried whether s 277(1)(c) of the CPA confers power on the Court to substitute a conviction where a person enters a guilty plea. Tyson Manicolo explains.
