Pardeep Tiwana is an experienced criminal barrister who signed the Bar Roll in England and Wales in 1993. He practised in England for 13 years. In that time, he appeared in numerous trials both for the prosecution and the defence. Some notable examples include:

  • Prosecution of a trial involving 12 defendants charged with conspiracy to supply cocaine and heroin. This involved a covert police operation spanning 2 years and raised issues of law relating to sensitive material.
  • Prosecuting a trial involving a series of armed robberies at post offices, one of the first trials that employed the use of prior similar convictions as coincidence evidence.
  • Appeared in the High Court (equivalent to our Supreme Court) in a number of homicide trials as junior counsel for the prosecution and the defence.

In April 2008 Pardeep Tiwana was admitted as a legal practitioner in Victoria and worked with a private criminal practice prior to signing the Bar Roll on 28 September 2009. Since then Pardeep has developed a defence practice appearing on behalf of those accused with sexual offending. He has appeared in all criminal jurisdictions from the Magistrates’ Court up to the High Court of Australia. He regularly appears in contests, committals, trials and pleas, representing those charged with sexual offending. He has also appeared in a number of cases in the Supreme Court and the Court of Appeal.

His cases include:

DPP v Dalgliesh (a pseudonym) [2017] HCA 41 (an important decision emphasising that current sentencing practices is one consideration amongst others when considering sentence. It is a factor but not a controlling one.)

DPP & DPP (Cth) v Swingler [2017] VSCA 305 (Commonwealth and State sentencing relating to sexual offending).

DPP v Dalgleish (a pseudonym) [2016] VSCA 148 (uplift of sentences in relation to incest offending)

Other work

Pardeep appeared on behalf of a youth justice officer in the Royal Commission into the Protection and Detention of Children in the Northern Territory.

He has appeared in a coronial inquest relating to a death in a psychiatric hospital unit on behalf of the family of the deceased.

Pardeep is a Victoria Legal Aid Criminal Trial Preferred barrister and holds a Victorian Bar Indictable Crime Certificate.

Pardeep regularly assists with advocacy teaching on the readers’ course and is an Accredited Advocacy Coach.

He is a mentor in the Solomon Island’s Mentoring Program.

Pardeep is on the Criminal Bar Association Committee.

He is on the County Court Criminal User Group.

Pardeep enjoys travelling, listening to Indian music and is an avid cricket fan. He has umpired cricket matches in the Box Hill District Reporters’ League.

He is fluent in Punjabi and Hindi.
