Profile

Sam Stafford’s practice spans the areas of occupational health & safety, inquests, high level statutory interpretation and regulatory advice, disciplinary tribunals, construction litigation and crime.

OH&S

Sam regularly acts for  employers and employees charged with OH&S offences under both State and Commonwealth OH&S legislation. He is also briefed to advise and prosecute on behalf of WorkSafe in relation to all OHS matters including workplace fatality and bullying cases.

INQUESTS

As a solicitor and a barrister Sam has acted in a large number of inquests for clients  including municipal councils, WorkSafe and other statutory bodies, electricity providers, Victorian Government departments, the Police Association, families of the deceased  and individual witnesses.

BUILDING REGULATION, PLANNING & DISCIPLINARY TRIBUNALS

Sam’s experience includes:

  • providing building, planning and environment prosecution advice to prosecuting authorities including councils and private clients defending charges brought by those authorities; and
  • advising and appearing for Victoria’s peak building industry bodies in prosecutions and disciplinary hearings brought by those bodies.

STATUTORY INTERPRETATION AND REGULATORY ADVICE

Sam provides high level regulatory advice and representation to individuals, corporations, Victorian Government departments and statutory bodies regarding:

  • the scope of statutory powers;
  • legislative interpretation;
  • proposed legislative and regulatory amendment; and
  • advising and appearing at contested subpoena hearings.

BUILDING DISPUTES

As a senior associate in the Construction and Major Projects group at Maddocks Lawyers, he acted in a large variety of arbitrations and building litigation in VCAT and the Supreme Court of Victoria. He regularly advised homeowners, contractors, statutory bodies and broad acre developers. Sam continues to advise and appear in construction disputes.

CRIME

Prior to joining Maddocks Lawyers, Sam was an associate at a leading criminal law firm and acted in numerous criminal trials, pleas and inquests. He has also worked for Victoria Legal Aid. Since coming to the bar, Sam continues to appear in  contested criminal hearings, bail applications and appeals and pleas. Sam is a member of the Criminal Bar Association.

Sam has been selected as a Victoria Legal Aid Criminal Trial Preferred barrister.

ACADEMIC AND SEMINARS

Sam has tutored business law and equity in the Griffith University Business and Law Schools and has conducted numerous seminars for law firms and their clients, associations and statutory bodies on topics such as building contract administration, risk minimisation, occupational health and safety, statutory interpretation, regulatory amendment, drafting techniques  and recent changes to the law.
