John Armstrong specialises in commercial litigation and telecommunications law.

John has particular experience in contractual and Australian Consumer Law disputes and commercial and domestic building disputes. 

In telecommunications, John advises carriers, wholesale and retail carriage services providers and government bodies in relation to the telecommunications regulatory regime and appears in Federal and Supreme Court proceedings involving telecommunications industry participants.

Matters in which John has advised and appeared include:

  • PIPE Networks Pty Ltd v Commonwealth Superannuation Corporation [2013] FCA 444 – proceedings brought by a telecommunications carrier to enforce its entitlement under the Telecommunications Act 1997 (Cth) to install optic fibre cables in the building at 101 Collins Street Melbourne; 
  • Peachbulk Pty Ltd v R T Edgar Pty Ltd & Ors [2011] VCC 1370 - a claim by the purchasers of two adjoining properties in Toorak that, in the course of negotiating the purchase of those properties, they were misled by a representation made by the selling agent that an offer had been made for the properties by another party when no such offer had, in fact, been made;
  • Anberton v Buller Ski Lifts [2006] VSC 106 - a dispute as to the construction of an agreement between the Mt. Buller Ski Lift company and the members of a previous operator of the ski lifts at Mt. Buller.

John is also experienced in asbestos disease claims and appeared in Berengo v Amaca & anor. [2010] VSC 496, a claim by Amaca Pty. Ltd. (James Hardie) for contribution from Seltsam Pty. Ltd. (Wunderlich) towards Amaca’s settlement in those proceedings with the plaintiff. 

Before coming to the Bar John was the Dispute Resolution Counsel at Telstra Corporation Ltd, having been at Telstra for 10 years, and a Senior Associate with the King Wood Mallesons (as it now is) dispute resolution group.
