PROFILE

Fiona McKenzie practises mainly in the area of administrative law. In recent years she has focussed on Aged Care work for Aged Care providers who are facing regulatory action by the Department of Health and Aged Care or the Australian Aged Care Quality Agency.

She has a strong academic background which includes a Master of Laws at the ANU, where she submitted a thesis on international human rights law issues arising in the Australian Federal jurisdiction. She has written a book for practitioners and decision makers, 'Administrative Power and the Law', which has been reviewed favourably here and in the UK.

Fiona appears in a range of tribunals and courts, and advises clients on the lawful exercise of statutory power, natural justice, statutory interpretation issues, and how to achieve compliance in the administrative law or regulatory spheres.

Types of matters include judicial review in the Supreme Court (eg review of medical panel opinions with KP Hanscombe SC), and the Federal Court; AAT proceedings including in FOI matters (eg The Australian v Sec, Dept of Prime Minister and Cabinet with Peter Hanks QC); VCAT matters involving merits review of administrative decisions; and advice.

Fiona has lectured at the University of Melbourne, teaching administrative law in the Juris Doctor Program.

She also conducts training in administrative decision making for lawyers and government decision-makers, based on her book, (see www.adminlaw.com.au).
